Article 33-38, Amendments to Regulation (EU) No 910/2014
Regulation (EU) No 910/2014 is amended as follows:
In Article 33, paragraph 2 is replaced with the following text:’
‘2. By 21 May 2025, the Commission shall, by means of implementing acts, establish a list of reference standards and, where necessary, establish specifications and procedures for qualified validation service referred to in paragraph 1 of this Article. Compliance with the requirements laid down in paragraph 1 of this Article shall be presumed where the qualified validation service for qualified electronic signatures complies with those standards, specifications and procedures. Those implementing acts shall be adopted in accordance with the examination procedure referred to in Article 48(2).’;
Article 34 is amended as follows:
(a) the following paragraph is inserted:
‘1a. Compliance with the requirements laid down in paragraph 1 shall be presumed where the arrangements for the qualified preservation service for qualified electronic signatures complies with the standards, specifications and procedures referred to in paragraph 2.’;
(b) paragraph 2 is replaced by the following:
‘2. By 21 May 2025, the Commission shall, by means of implementing acts, establish a list of reference standards and, where necessary, establish specifications and procedures for the qualified preservation service for qualified electronic signatures. Those implementing acts shall be adopted in accordance with the examination procedure referred to in Article 48(2).’;
In Article 35, paragraph 3 is deleted;
Article 36 is amended as follows:
(a) the single paragraph becomes paragraph 1;
(b) the following paragraph is added:
‘2. By 21 May 2026, the Commission shall assess whether it is necessary to adopt implementing acts to establish a list of reference standards and, where necessary, establish specifications and procedures for advanced electronic seals. On the basis of that assessment, the Commission may adopt such implementing acts. Compliance with the requirements for advanced electronic seals shall be presumed where an advanced electronic seal complies with those standards, specifications and procedures. Those implementing acts shall be adopted in accordance with the examination procedure referred to in Article 48(2).’;
In Article 37, paragraph 4 is deleted;
In Article 38, paragraph 6 is replaced by the following:
‘6. By 21 May 2025, the Commission shall, by means of implementing acts, establish a list of reference standards and, where necessary, establish specifications and procedures for qualified certificates for electronic seals. Compliance with the requirements laid down in Annex III shall be presumed where a qualified certificate for electronic seal complies with those standards, specifications and procedures. Those implementing acts shall be adopted in accordance with the examination procedure referred to in Article 48(2).’;
